Participant Waiver, Release of Liability, Indemnification, and Assumption of Risk Agreement

WARNING: READ CAREFULLY. THIS AGREEMENT AFFECTS YOUR LEGAL RIGHTS. EVERY ADULT PARTICIPANT MUST COMPLETE THEIR OWN WAIVER. A PARENT OR LEGAL GUARDIAN MUST COMPLETE THIS WAIVER FOR ANY PARTICIPANT UNDER THE AGE OF 18.

Acknowledgement and Assumption of Inherent Risks

I, the participant named above, acknowledge that participation in axe throwing activities is an inherently dangerous activity. I understand that these risks, whether known or unknown, can result in serious physical or emotional injury, paralysis, permanent disability, death, and/or property damage.

I specifically acknowledge and voluntarily assume the following risks:

Risk of Injury from Axes:

I understand that axes are sharp and can cause serious injury. Risks include, but are not limited to, being struck by a thrown axe, a dropped axe, or a splintering axe handle.

Risks from the Environment:

I am aware of risks including wood splinters from targets, slippery floors, and other potential hazards within the facility.

Risks from Other Participants:

I understand that the actions of other participants, whether accidental or intentional, are outside the control of 307 Hatchet House and can pose a significant risk.

Health and Exertion:

I acknowledge that this activity requires physical exertion, which may strain my body and could lead to injury.

Section 3:
Release of Liability and Indemnification Agreement

In consideration for being permitted to participate in the activities at 307 Hatchet House Cheyenne, LLC (hereafter "the Company"), I, on behalf of myself, my heirs, representatives, and estate, hereby agree to the following:

I hereby RELEASE, WAIVE, DISCHARGE, AND COVENANT NOT TO SUE the Company, its owners, members, officers, employees, instructors, agents, and the property owners (collectively, the "Released Parties") from any and all liability, claims, demands, actions, or rights of action, which are related to, arise out of, or are in any way connected with my participation in this activity, INCLUDING, BUT NOT LIMITED TO, ANY AND ALL CLAIMS ARISING FROM THE NEGLIGENCE of the Released Parties.

I further agree to INDEMNIFY AND HOLD HARMLESS the Released Parties from any loss, liability, damage, or costs, including court costs and attorney's fees, that they may incur due to my participation in this activity, whether caused by my own negligence or the negligence of the Released Parties.

Section 4:
Health and Conduct Agreement

I certify that I am in good physical and mental health and am physically able to participate in axe throwing. I am not under the influence of any drugs, alcohol, or other substances that would impair my judgment or physical abilities.

I agree to listen to and obey all rules, warnings, and instructions provided by the 307 Hatchet House staff ("Adventure Coaches") at all times. I understand that the Company reserves the right to remove me from the premises without a refund if my conduct is deemed unsafe or inappropriate.

Section 5:
Photo and Video Release

I hereby grant the Company permission to use photographs and/or video recordings of me taken at the facility for promotional and marketing purposes without compensation.

By signing below, I acknowledge that I have read this entire document, I fully understand its terms, and I am aware that I am giving up substantial legal rights, including the right to sue. I am signing this agreement freely and voluntarily.

Parent/Guardian Consent

I, the undersigned parent or legal guardian, am signing on behalf of the minor participant named below. I have read and agree to all terms of this agreement on behalf of the minor and myself. I acknowledge that I am giving up legal rights for both myself and the minor. I agree to indemnify and hold harmless the Released Parties for any liability arising from the minor's participation.
